Dating a legally separated man..my dilemma?

I have been seeing this guy for about a month now, and I really enjoy his company. The lingering problem is that he is not yet divorced. He married last year though a marriage arranged by his family (eastern culture here) but they soon separated 5 months after the wedding. He is living back with his family and she with hers. Even though he tells me they both agree there is nothing good about their marriage and they both have quietly and mutually agreed to no-fault divorce proceedings, is he still technically available to date me? We have not been intimate or anything yet because I told him I feel uncomfortable with it bc of his situation, but the more time I spend with him the more I feel and the more he says he feels for me. I think of myself as a bit conservative and I always never believed I would date someone separated but, in this situation is it best just to wait it out until the divorce is final or is legally separated living apart technically "single"? Would I be considered an adulteress?
